Emergency Closing Policy

Although the company will make every effort to remain open for business on scheduled workdays, there may be instances where conditions make it impossible to do so. These include, but are not limited to, severe weather, declared state of emergency, utility disruptions, natural disasters and terrorist actions. In all cases employee safety will be the primary consideration. The following procedures will set forth employer and employee obligations regarding reporting to work, use of leave and pay issues when circumstances impact the organization’s ability to be open for business.

Procedures

  1. The company reserves the right to make decisions regarding emergency closings that are believed to be in the best interests of the safety of all employees.
    • Updates will be posted on Bard's website for employee information, www.bardhvac.com/bryan
    • The Bard Emergency alert text messaging system will be used to make closure announcements.
    • Employees can call 419-633-6724 to listen to a recorded message for closure announcements. 
  2. Union Employees:

Non-exempt, hourly/union employees who report  for a regularly scheduled shift without previous notice through an agreed upon medium that no work is available and are sent home, shall receive a minimum of three  (3)  hours pay at their regular straight time rate, except when circumstances are beyond the control of the Company.  Any overtime that was scheduled for a “cancelled” day shall be rescheduled on the first workday when work resumes. (Example: if OT is scheduled for Tuesday and Tuesday’s work is cancelled due to a snowstorm, the OT schedule will be applied to Wednesday if that is the first day back to work.)  If an employee scheduled for the overtime on the cancelled day provides advance notification that he is unavailable to work the rescheduled overtime, the employee will not receive any points under the attendance policy for not working the rescheduled overtime.  Should a reported closure result in no work being performed at all on a scheduled workday, no compensation will be provided.

The following attendance policy will be followed as it relates to winter weather:

Level 1 - Roadways are hazardous, drive very cautiously.                   

                Contractual attendance policy to be followed.

  

Level 2 – Roadways are hazardous with blowing and drifting snow, roadways are also icy.  Only those who feel it is necessary to drive should be out on the roadways.  Contact your employer to see if you should report to work.

Contractual attendance policy to be followed for Floating vacation and Floating Holidays.   Additional absents or lates will be excused as a “Weather Day”.  This is a no point no pay situation.

 

Level 3 – All roadways are closed to non-emergency personnel.  No one should be out during these conditions unless it is absolutely necessary to travel.  All employees should contact their employer to see if they should report to work.  Those traveling on the roadways may subject themselves to arrest.

Plant will be closed.   Employees will be allowed to use Vacation Days, Floating Vacation Days, Floating Holidays, or a Weather Day.

 

  1. Non-Exempt and Exempt Office Employees

In the event that the facility is closed and no work is performed, non-exempt and exempt office employees shall still be paid for the normal hours that they were scheduled for that day (to a maximum of 8 hours).  If an employee reports for a regularly scheduled shift without previous notice that no work is available and is sent home, he/she will be paid his/her normal daily salary, up to a maximum of 8 hours.  Those employees who scheduled paid time off (vacation, floating holiday, etc.) for a day that results in an emergency closure will still use the scheduled paid time off.

Please note:  if Williams County is under a Level 3 snow emergency, you are to stay home.  Employees should not attempt to come to work or expect to be paid overtime for time worked unless their presence is requested and approved by a supervisor.  When the facility is closed, office employees will be paid for the number of hours the facility is closed during their shift (to a maximum of 8 hours).  Those hours will not count as time worked toward the calculation of overtime for that week.

Employees who are late or who choose not to report to work when the office is otherwise open should contact their supervisors to request personal/vacation days or to make up the time.
